Mis-Sold Student Loans

The next major financial mis-selling scandal

Student Loans may be challenged on a number of legal bases:

    1. They have been provided without any meaningful assessment of suitability and affordability;
    2. No fact find or due diligence was completed;
    3. An inadequate sales “take it or leave it” process was often followed;
    4. Key risks were not identified;
    5. Key terms (such as rate of interest applicable) were not been explained;
    6. Loan Agreements and key terms were difficult to locate and often hidden away rather than simply being given to students to sign;
    7. This was often the first loan that students took out and they were not asked to take independent financial or legal advice or to shop around;
    8. Student loans are expensive when compared against other forms of lending such as bank loans and mortgages and increase in cost year on year.
    9. Student loans typically incur high interest while students are studying (often RPI plus a high margin).
    10. Loan agreements give the Student Loans Company the ability to change loan terms after the agreements have been entered into.

“Jamie has been excellent to work with, Jamie stepped in and made a series of challenging evidenced based arguments in my case using his expertise as to where there had been legal failings. Without Jamie, I don’t think I would be able to get my dispute resolved. “
